Welcome to SIMF Real Estate Platform (the “Site”). These Terms of Service (the “Terms”) govern your access to and use of the Site and any services, features, or content provided through it. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site.
The Site is intended for individuals who are at least 18 years old and who can enter into legally binding contracts under applicable law. By using the Site, you represent and warrant that you meet these requirements and that you will use the Site only for lawful purposes and in accordance with these Terms.
Some features of the Site may require you to create an account or verify your email address. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us promptly of any unauthorized access to or use of your account. You must not share, sell, or transfer your account to any other person.
The Site offers two types of accounts:
Agent Accounts may contain publicly visible business information supplied by the agent. The accuracy and legality of all provided information, including external links, is the sole responsibility of the account owner.
Agents may publish business-related information in their profiles, including the name of their real estate company, office address, telephone number, and a URL linking to their official website. This information becomes publicly visible on the Site.
The Site does not verify the accuracy, authenticity, or legality of any business information or external links provided by agents. All responsibility for such information lies solely with the agent who publishes it.
The Site allows users to submit content, including but not limited to property listings, descriptions, photos, images, messages, and other materials (collectively, “User Content”). You retain ownership of your User Content, but by submitting it to the Site you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute such content solely in connection with operating and promoting the Site.
By submitting User Content, you represent and warrant that:
The Site is a real estate listing platform that allows users to publish and view property information. The Site and its owner are not a real estate broker, agent, or legal advisor and are not a party to any transactions between buyers, sellers, landlords, or tenants. All property information, including prices, availability, descriptions, photos, and other details, is provided by users or third parties and is not independently verified by the Site.
We do not guarantee the accuracy, completeness, or timeliness of any listing or other information on the Site. You are solely responsible for conducting your own due diligence, inspections, and professional consultations before entering into any real estate transaction.
The Site Administration reserves the right to limit the number, size, format, and resolution of images or other media uploaded to property listings or user profiles. These limits may be changed at any time to ensure platform performance, storage efficiency, and security.
Users and agents are fully responsible for ensuring that all uploaded files comply with the Site’s technical requirements and do not exceed the permitted limits. The Site Administration may remove, block, or compress files that violate these rules or negatively affect system stability.

By using the Site, you acknowledge that you have read and understood the Privacy Policy, and you agree to its terms.

We are not responsible for the content, policies, or practices of any third-party services, and your use of such services is at your own risk.
All rights, title, and interest in and to the Site, including its design, layout, logos, trademarks, text, graphics, and underlying code, are owned by the Site owner or licensed to it, and are protected by applicable intellectual property laws. Except as expressly allowed by these Terms or by written permission, you may not copy, modify, distribute, sell, or create derivative works based on any part of the Site.
From time to time, the Site may feature optional virtual activities or mini-games, including but not limited to “Collect the Collection” or similar experiences involving virtual characters or items known as “Simfies” (the “Simfies Games”).

The Site and all content, services, and features are provided on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Site will be uninterrupted, secure, or free from errors, viruses, or other harmful components, or that any information or content obtained through the Site will be accurate, reliable, or complete.
To the maximum extent permitted by law, in no event shall the Site owner, its administrators, or any affiliated persons be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Site, your reliance on any content, or your participation in any Simfies Games, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any and all claims arising out of or related to the Site or these Terms shall be limited to the amount you have paid (if any) for using the Site during the twelve (12) months immediately preceding the event giving rise to the claim, or one U.S. dollar (USD 1.00), whichever is greater.
You agree to indemnify, defend, and hold harmless the Site owner, its administrators, and any affiliated persons from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Site; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity.
We reserve the right, in our sole discretion, to suspend or terminate your access to the Site or your account at any time, with or without notice, if we believe that you have violated these Terms or engaged in any activity that may harm the Site, other users, or any third party. We also reserve the right to remove or modify any User Content at any time.
These Terms and any dispute arising out of or relating to the Site shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in New York for the resolution of any such disputes.
We may update, modify, or replace these Terms from time to time. The most current version will always be posted on this page. Your continued use of the Site after any changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Site.
The Site Administration may modify, add, or remove any part of these Terms at any time, without prior agreement with or notice to users.
